These Terms & Conditions (“Terms”) govern your use of the 55 Sportswear website, online merchandise stores, and the purchase of products and services offered by 55 Sportswear (“55 Sportswear,” “we,” “us,” or “our”).
By placing an order through our website or an online merchandise store operated by 55 Sportswear, you acknowledge that you have reviewed and accepted these Terms, subject always to any rights you may have under applicable consumer-protection legislation.
- Our Products
55 Sportswear provides sportswear, team apparel, merchandise, uniforms, branded apparel, and related products.
Product images, colours, descriptions, availability, and pricing are provided as accurately as reasonably possible. Actual colours may vary depending on your device, screen settings, production process, fabric, or manufacturer.
Products may be sourced from different manufacturers and suppliers. Therefore, availability, styles, colours, and specifications may change.
- Orders and Customer Responsibility
Customers are responsible for reviewing their order before completing the purchase, including:
- Product
- Colour
- Quantity
- Name or personalization, where applicable
- Size
- Delivery information
- Any other information submitted with the order
- Once an order has been submitted for production or fulfillment, changes or cancellations may not be possible.
For this reason, customers should carefully review all selections before completing an order.
- Sizing and Customer-Selected Wrong Sizes
Please choose your size carefully before placing your order.
Because many products are ordered, decorated, customized, or specifically allocated for individual customers, 55 Sportswear does not accept standard returns or exchanges solely because a customer selected the wrong size.
This includes situations where:
- The customer ordered a size that does not fit;
- The customer later determines that a different size would have been preferable; or
- The customer changes their mind regarding the selected size.
However, we will work with you to find the best reasonable solution whenever possible.
If you realize that you selected the wrong size, contact us as soon as possible.
Any solution offered will depend on the circumstances, product availability, production status, and applicable costs.
- Incorrect, Damaged, or Defective Products
The policy regarding customer-selected sizing does not limit any rights a customer may have where:
55 Sportswear supplied the wrong product;
- 55 Sportswear supplied the wrong size compared with the size ordered;
- The product arrives damaged;
- The product has a manufacturing defect; or
- The product materially differs from what was ordered.
- Please contact us as soon as possible after receiving the product and provide details and, where appropriate, photographs.
We will review the situation and work with you toward an appropriate solution.
Nothing in these Terms is intended to exclude or restrict rights that cannot legally be excluded or restricted under applicable consumer-protection law.
- Delivery
Our standard delivery timeframe is approximately:
10–20 business days.
Delivery times may vary depending on product availability, supplier production schedules, customization, order volume, holidays, shipping conditions, and circumstances outside our reasonable control.
We will make reasonable efforts to keep customers informed of significant delays.
Product Availability
If a product selected by a customer becomes unavailable, is discontinued, or cannot reasonably be supplied within the expected timeframe, 55 Sportswear will contact the customer to offer an appropriate solution.
Depending on the circumstances, the solution may include an alternative product, alternative colour or model, a revised delivery timeframe, or another mutually acceptable arrangement.
- Free Delivery in Greater Victoria
55 Sportswear provides free standard delivery within the Greater Victoria Area for qualifying orders.
Delivery coverage may be determined by the delivery address and our available delivery service.
If you are unsure whether your address qualifies, contact us before placing your order.
- Exchanges or Size Solutions
Where 55 Sportswear agrees to assist with a customer-selected sizing issue, the following delivery arrangement applies:
The customer is responsible for the cost of getting the original product from the customer’s location to the 55 Sportswear office;
Once the replacement or alternative product is approved and available, delivery of the new product to the customer is free of charge within our normal Greater Victoria delivery area;
Any difference in product price, if applicable, may be payable by the customer;
Any proposed solution remains subject to product availability and the condition and production status of the original product.
This process is intended to help customers find a practical solution even though customer-selected sizing is not covered by our standard exchange policy.
- Personalization and Customized Products
Products that are customized, personalized, printed, embroidered, decorated, or otherwise produced specifically according to customer instructions may be subject to additional restrictions regarding cancellation, return, or exchange.
Customers are responsible for carefully reviewing names, numbers, logos, spelling, sizes, colours, and other information submitted for customization before approving an order.
- Prices and Taxes
All prices are displayed in Canadian dollars unless otherwise stated.
Applicable taxes will be charged as required by law.
Prices and product availability may change without notice before an order is accepted.
Once an order has been accepted and paid, the applicable order price will generally be the price confirmed at checkout, subject to correction of obvious errors and applicable law.
- Payments
Payment must be completed through the payment methods made available by 55 Sportswear or its payment providers.
An order may not be processed until payment or other required authorization has been received.
55 Sportswear reserves the right to refuse or cancel an order where there is a reasonable concern regarding payment, fraud, unauthorized activity, pricing errors, or product availability, subject to applicable law.
- Online Merchandise Stores
Where 55 Sportswear operates a merchandise store for a team, school, club, association, organization, or other group, the products, prices, delivery terms, and store availability applicable to that store will be displayed on the relevant store page.
Store products and availability may change over time.
A store may be updated, temporarily closed, or discontinued according to the agreement between 55 Sportswear and the applicable organization.
- Intellectual Property
The 55 Sportswear name, logo, website content, graphics, photographs, designs, text, and other original materials belonging to 55 Sportswear may not be copied, reproduced, distributed, modified, or commercially used without permission.
Logos, trademarks, names, and other intellectual property supplied by customers or organizations remain the property of their respective owners.
By providing artwork, logos, names, or other materials to 55 Sportswear for production or promotional purposes, the customer represents that they have the necessary authority to use and provide those materials.
- Website Use
Customers agree not to:
- Use the website for unlawful purposes;
- Attempt to gain unauthorized access to our systems;
- Interfere with the operation or security of the website;
- Submit fraudulent orders or information;
- Upload malicious code or harmful material; or Use the website in a manner that could damage 55 Sportswear or other users.
- Third-Party Services
55 Sportswear may use third-party providers for payment processing, website hosting, production, shipping, analytics, communications, and other business functions.
Third-party services may have their own terms and privacy policies.
55 Sportswear is not responsible for the independent policies or practices of third-party service providers except to the extent required by applicable law.
- Limitation of Liability
To the extent permitted by applicable law, 55 Sportswear will not be responsible for indirect, incidental, special, or consequential losses arising from the use of our website or products.
Nothing in these Terms excludes or limits liability, warranties, guarantees, or consumer rights that cannot legally be excluded or limited under applicable law.
- Force Majeure
55 Sportswear will not be responsible for delays or failures caused by circumstances outside our reasonable control, including but not limited to:
- Supplier shortages;
- Manufacturing delays;
- Shipping disruptions;
- Natural disasters;
- Severe weather;
- Labour disruptions;
- Government actions;
- Transportation interruptions;
- Internet or technology failures; or
- Other circumstances beyond our reasonable control.
Where such circumstances occur, we will make reasonable efforts to communicate with affected customers and provide an appropriate solution.
- Cancellation and Consumer Rights
Nothing in these Terms is intended to remove or restrict rights provided to consumers under applicable British Columbia or Canadian law.
For online purchases, applicable consumer-protection legislation may provide specific requirements concerning distance sales, cancellation rights, refunds, disclosures, and contracts.
Where a statutory right applies, that right takes precedence over any conflicting provision of these Terms.
